Article 1: Purpose

The purpose of the Terms of Use is to stipulate the conditions of use for Hwadam Botanic Garden and its website (www.hwadamsup.com or m.hwadamsup.com), rights, obligations, responsibilities, and other necessities of Users and Hwadam Botanic Garden.

Article 2: Effect of Terms of Use

The Terms of Use shall become effective when posted on the Hwadam Botanic Garden website or notified to members via email or other means.

Article 3: Definition of Terms

The definitions of terms used in the Terms of Use are as follows:

1. "User" shall mean a person who receives services provided by Hwadam Botanic Garden in accordance with the Terms of Use.

2. "Admission Ticket" shall mean a ticket for admission to the Hwadam Botanic Garden.

3. "Experience Program" shall mean a User experience program conducted within Hwadam Botanic Garden and may be sold in combination with an Admission Ticket or monorail boarding pass.

4. "Voucher" shall mean a Hwadam Botanic Garden Admission Ticket, monorail boarding pass, or ticket purchased for participation in an Experience Program.

5. "Usage Agreement" shall mean a Voucher purchase agreement concluded between a User and Hwadam Botanic Garden.

6. "Website" shall mean the official Hwadam Botanic Garden website (www.hwadamsup.com or m.hwadamsup.com).

7. "Invalid Ticket" shall mean a Voucher that is resold or traded via a third-party purchasing agent for the purpose of financial gain using means other than the on-site Hwadam Botanic Garden ticket office or the Website.

Article 4: Disclosure and Amendment of Terms of Use

1. In the interest of Users, Hwadam Botanic Garden shall clearly disclose on the initial main page of the Website the contents of the Terms of Use and information such as the name of the business and CEO, business address (including the address where consumer complaints shall be handled), phone number, email address, Business Registration Number, Telecom Retail Business Registration Number, and Privacy Officer. However, the contents of the Terms of Use may be made available to Users via a link.

2. Prior to a User agreeing to the Terms of Use, Hwadam Botanic Garden shall provide a separate link or pop-up window so that the User may view and understand important information such as subscription withdrawal and refund conditions stipulated in the Terms of Use.

3. Hwadam Botanic Garden shall provide services to a User on the condition that the User agrees to the Terms of Use. If the User agrees to the contents of the Terms of Use, the Terms of Use shall take precedence over Hwadam Botanic Garden's provision of services and the User's use of said services.

4. The Terms of Use may be amended to the extent that no relevant laws and regulations are violated, including, but not limited to, the Act on the Regulation of Terms and Conditions, Framework Act on Electronic Documents and Transactions, Digital Signature Act, Act on Promotion of Information and Communications Network Utilization and Information Protection, Act on Consumer Protection in Electronic Commerce, Framework Act on Consumers, and Act on the Protection and Use of Location Information.

5. In the event that Hwadam Botanic Garden amends the Terms of Use, the effective date and the reason for the amendment shall be specified and announced along with the current Terms of Use on the initial main page of the Website from seven (7) days before the effective date to the day before the effective date.

6. In the event that Hwadam Botanic Garden amends the Terms of Use, the amended Terms of Use shall be applied only to Usage Agreements concluded after the effective date, and the previous Terms of Use shall continue to apply to Usage Agreements concluded prior to said effective date.

Article 5: Protocol for Terms of Use

1. The Terms of Use shall apply in conjunction with other regulations of use and policies for services provided by Hwadam Botanic Garden.

2. Matters not specified in the Terms of Use and the interpretation of said Terms of Use shall be governed by the Act on Consumer Protection in Electronic Commerce and other relevant laws and regulations enacted by the government agencies of the Republic of Korea.

Article 6: Establishment of Usage Agreement

1. A User shall be deemed to have agreed to a Usage Agreement if the User ticks the checkboxes (Consent to All Terms of Use, Collection and Use of Personal Information, Hwadam Botanic Garden Usage Guide, Provision of Personal Information to Third Parties, and Consent to Receive Marketing Information) displayed below the phrase ""I agree to the Terms of Use for online booking"" on the Book Online page of the Hwadam Botanic Garden Website (desktop or mobile version) and clicks the Next button at the bottom.

2. A Usage Agreement shall be established when a prospective purchaser of a Voucher enters information for requested items (date of use, name, phone number, etc.) on the predetermined online booking page provided by Hwadam Botanic Garden and completes the purchase and payment of an Admission Ticket or Experience Program.

3. A User may use services provided by Hwadam Botanic Garden when the User agrees to the following:

• a. Resale of a Hwadam Botanic Garden Voucher for financial gain using means other than the on-site Hwadam Botanic Garden ticket office or the Website is prohibited.
• b. Purchasing a Hwadam Botanic Garden Voucher as an agent for financial gain using means other than the on-site Hwadam Botanic Garden ticket office or the Website is prohibited.
• c. Upon confirmation of a Voucher resale or agent purchase, Hwadam Botanic Garden shall immediately terminate the corresponding Usage Agreement and cancel the issuance of the Invalid Ticket, and the person responsible for reselling the Invalid Ticket shall be prohibited from entering into another Usage Agreement for three (3) years.
• d. To maintain a pleasant viewing experience for Users, Hwadam Botanic Garden prohibits bringing in food and may check the contents of a User's brought-in items.
• e. Hwadam Botanic Garden does not allow pets except guide dogs for the visually impaired.
• f. The following items are prohibited at Hwadam Botanic Garden:
  - Alcoholic beverages, picnic blankets/mats, tents, sun shelters, cooking utensils, kick/electric scooters, agricultural tools, tripods, drones, etc.
  - Other items that may cause inconvenience to other Users
• g. Smoking and consumption of alcoholic beverages are prohibited at all facilities related to Hwadam Botanic Garden, including gardens, plazas, waiting areas, dining areas, and parking lots.

Article 7: Payment Method for Voucher Purchase

Payment of the purchase price of a Voucher may be made via one of the following methods. In the event of a legal or technical problem or unforeseen failure (e.g., bank communication network failure), a User may be requested to change the payment method, or the payment may be suspended or rejected according to the policy.

1) Real-time account transfer via mobile banking or online banking

2) Payment by card, including a prepaid card, debit card, or credit card

3) Mobile phone-based micro payment

Article 8: Refund of Voucher Purchase Payment

The refund policy for non-visits and reservation cancellations by a User is as follows:

1) Full refund of the payment amount if reservation is canceled by 23:59 on the day before the expected date of visit during peak season as designated by Hwadam Botanic Garden.

2) Partial refund sans 30% of the payment amount in case of non-visit and reservation cancellation on the expected date of visit during peak season as designated by Hwadam Botanic Garden.

3) Full refund of the payment amount in case of non-visit and reservation cancellation outside of the peak season as designated by Hwadam Botanic Garden.

4) Reservations without visits (no-shows) shall be automatically canceled after the end of the expected date of visit, which may require up to five to six (5 to 6) business days to be processed by the respective credit card company.

Article 9: Termination of Usage Agreement

Hwadam Botanic Garden may cancel a User's purchase in the following cases and shall not bear any liability for damages other than a full refund of the payment amount:

1) If a User transfers or attempts to transfer a purchased Voucher to another person for financial gain.

2) If a User purchases a Voucher for the purpose of disrupting social order or public morals or has done so.

3) If operation is impossible due to on-site conditions such as severe weather, natural disasters, epidemics, etc.

4) Other cases where deemed necessary for normal service operation of Hwadam Botanic Garden.

Article 10: Penalty for Breach of Contract

Hwadam Botanic Garden may impose a per-instance penalty amount equivalent to 10 times the price of a Voucher for the following acts committed by a User:

If a User transfers or attempts to transfer a purchased Voucher to another person as form of enterprise.

Article 11: Obligations of a User

1. A User shall be prohibited from registering false information when applying for or changing a reservation.

2. A User shall be prohibited from stealing the personal information of other people.

3. A User shall be prohibited from infringing on intellectual property rights such as copyrights of the Website or other third parties.

4. A User shall be prohibited from performing actions that may damage the reputation or interfere with the business of Hwadam Botanic Garden or other third parties.

Article 12: Attribution of Copyright and Restrictions on Use

1. Copyright, trademark rights, and other intellectual property rights for works produced and displayed by Hwadam Botanic Garden shall belong to Hwadam Botanic Garden.

2. Information for which intellectual property rights belong to Hwadam Botanic Garden obtained via the use of Hwadam Botanic Garden may not be used by a User for commercial purposes or allow a third party to use said information by copying, transmitting, publishing, distributing, broadcasting, or other methods without the prior consent of Hwadam Botanic Garden.

Article 13: Jurisdiction and Governing Law

1. The laws and regulations of the Republic of Korea shall apply to the interpretation of the Terms of Use and disputes arising between Hwadam Botanic Garden and a User.

2. Legal disputes between Hwadam Botanic Garden and a User arisen from the use of Hwadam Botanic Garden shall be governed by the Seoul Central District Court or the competent court in the jurisdiction of the User's address.

Addendum: Effective Date

1. The Terms of Use shall be effective as of Jun 9, 2023.
